Privacy Policy

Last Updated: November 2, 2026

1. Who We Are and What This Policy Covers

Concept99Group Franchising, LLC, doing business as Jerry J's ("we," "us," or "our"), respects your privacy. This Privacy Policy describes the personal information we collect, where it comes from, how we use it, who we share it with, and the choices and rights you may have. It applies when you:

  • visit our website at https://www.jerryjs.com (the "Site") or use our mobile app (the "App");
  • place an order, join our loyalty program, create a guest account, or rate or review our menu items;
  • sign up for our emails or text messages;
  • send us a form through the Site or App, such as a contact, feedback, catering or employment form, or enter a promotion we run; or
  • otherwise interact with us where this Privacy Policy is posted or linked (together, the "Services").

Some Jerry J's restaurants are owned and operated by independent franchisees. When you order from, apply to work at, or contact a particular restaurant, that restaurant receives the information needed to serve you and handles it as described in this policy.

2. Information We Collect

"Personal information" means information that identifies you or could reasonably be linked to you. Depending on how you use the Services, we collect:

  • Contact and profile information. Name, email address, phone number, postal address, and, if you choose to share them, your birthday and a profile photo.
  • Account information. The login details for a guest account. If you sign in with a third-party login (such as Google or Facebook), we receive the information that service's settings allow.
  • Order information. Items ordered, order history, amounts, pickup or delivery details, and any special instructions.
  • Loyalty information. Your participation in our loyalty program, such as points earned and rewards redeemed.
  • Payment information. Online payments are handled by our third-party payment processor. We do not store your full card number; we receive limited details (such as card type, the last four digits and confirmation of payment) needed to complete and support your order.
  • Content you submit. Ratings, reviews, photos, survey answers and other content you send us or post.
  • Form submissions. What you enter in a contact, feedback or catering form, such as event dates, headcount and how to reach you.
  • Job applications. If you apply to work at one of our restaurants, the information in your application, such as your contact details, the position and restaurant, pay and hours wanted, availability, work history, and your answers to the application's other questions.
  • Promotion entries. If you enter a giveaway or contest we run, the information on your entry, such as your name and contact details on a paper or online entry form, or your social media handle and comment when a giveaway is entered by commenting.
  • Dietary preferences. Allergen or dietary information you choose to share. Some states treat this as sensitive information; see Section 12.
  • Device and usage information. Your IP address, device, browser and operating system, the pages you visit and the page that sent you, dates and times of visits, and how you use the Services (such as clicks, scrolling and searches). Your interactions with the Services, including the ordering and checkout flow, may be recorded and replayed by our platform provider to fix problems and improve the Services ("session replay").
  • General location. An approximate location (such as city) inferred from your IP address.
  • Inferences. Preferences we draw from the information above, such as favorite items or how often you visit.
  • Communications. Messages you send us (including through our forms, email, and our social media pages), reviews you post about us on other sites, your communication preferences, and whether our marketing messages were delivered, opened or clicked.

3. Where We Get It

  • From you, when you order, create an account, join the loyalty program, sign up for emails or texts, submit a form or application, enter a promotion, write a review or contact us.
  • Automatically, through cookies and similar technologies when you use the Site or App (Section 9).
  • From other services we use, such as our restaurants' point-of-sale system, our online ordering and marketing platform, delivery providers, and social media and review sites.

4. How We Use It

  • To provide the Services: to take, prepare and deliver your orders, keep your account and loyalty points, and show your reviews.
  • To communicate with you about your orders, forms, applications and requests. We use service providers, including AI tools, to help sort guest messages and draft replies. Thank-you replies to positive reviews are written and posted automatically; a team member reviews other replies before they are sent.
  • To send marketing emails and, with your consent (Section 5), marketing texts about our food, specials, events and promotions. Some marketing emails are scheduled to send automatically, and some of our marketing content is drafted with the help of automated and AI tools. You can unsubscribe at any time.
  • To review job applications and contact applicants.
  • To run promotions, giveaways and contests, including choosing and contacting winners, delivering prizes, and announcing winners as the official rules describe.
  • To personalize the Services, such as remembering your preferences.
  • To operate, analyze and improve the Site, the App and our restaurants.
  • To prevent fraud and misuse (including of loyalty points and promotions), keep the Services secure, and manage risk.
  • To comply with the law, enforce our terms, and respond to lawful requests.
  • For other purposes we describe when we collect the information, or with your consent.

5. Text Messages

Marketing texts. If you opt in to Jerry J's marketing texts, we will send you recurring marketing and promotional text messages, which may be sent using an automated system. Consent to receive marketing texts is not a condition of any purchase. Message frequency varies. Message and data rates may apply. Reply STOP to any message to opt out, or HELP for help. You can also email us at tysons@c99g.net. Carriers are not liable for delayed or undelivered messages.

Order texts. If you give your phone number when you place an order, we may text you about that order, such as confirmations and status updates. These are not marketing messages. Message and data rates may apply. Reply STOP to opt out or HELP for help.

Sign-in codes. If you sign in or sign up with your mobile number, we text you a one-time passcode to verify it. Message and data rates may apply.

Mobile information. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. We keep records of your phone number, your opt-in and your opt-out so we can honor your choices.

6. Who We Share It With

  • Popmenu, our website, ordering and marketing platform. When you use the Site, App, menus, ordering or loyalty tools, you provide information to both us and Popmenu, Inc. Popmenu processes it as our service provider to run the Services, and also uses certain information for its own purposes as an independent business (for example, to operate and improve its services). Popmenu's own practices are described in its privacy policy at https://my.popmenu.com/privacy, and we encourage you to read it.
  • Our restaurants. The Jerry J's restaurant you order from, apply to or contact, including its management and, for a franchised restaurant, its owner, so it can serve you or review your application.
  • Payment processors, to process payments.
  • Delivery providers. If you choose delivery, your name, address, phone number and order details go to the delivery provider that brings your order.
  • Point-of-sale provider. Online orders are sent to our restaurants' point-of-sale system so the restaurant can prepare them.
  • Other service providers that perform services for us, such as hosting and data storage, email and text delivery, AI tools that help us read messages, and job-application tools. They may use personal information only to perform services for us.
  • Gift card and prize partners. Gift cards bought through a link on the Site are sold by a third-party gift card provider under its own terms and privacy policy. To deliver a prize, we may share a winner's name and contact details with the business providing it.
  • Legal and safety. When we believe in good faith that the law requires it, or to protect the rights, property or safety of our guests, team members, business or others.
  • Business transfers. In connection with a merger, sale, financing or reorganization of all or part of our business.

None of these categories includes text messaging originator opt-in data and consent; that information will not be shared with any third parties.

We do not sell your personal information.

7. Reviews and Other Public Content

Ratings and reviews you post on our menus are public, along with the display name and photo on your guest account. Please do not include anything in a review that you do not want to be public. Reviews are stored and shown through the Popmenu platform and may stay available there as described in Popmenu's privacy policy.

8. Your Choices

  • Email. Use the unsubscribe link in any marketing email. We may still email you about your orders.
  • Texts. Reply STOP to any marketing text.
  • Guest account. Log in to update your name, email, birthday and photo and to manage your email preferences.
  • Deletion. You can ask us to delete your account and personal information (Section 12). Some information may be kept or de-identified where the law allows or requires.
  • Cookies. See Section 9.
  • App permissions. You can turn off notifications and other device permissions at any time in your device settings.

9. Cookies and Analytics

The Services use cookies and similar technologies. A cookie is a small data file placed on your device.

  • Essential and functional cookies remember your settings, cart and login and make the Services work. Some features will not work without them.
  • Analytics. Our platform provider uses third-party analytics, including Google Analytics, Snowplow and FullStory, to measure use of the Services, including session replay as described in Section 2.

Most browsers let you delete or block cookies or warn you before one is set. The Services do not respond to browser "Do Not Track" signals, for which there is no common standard.

10. Our Mobile App

The App is powered by the Popmenu platform. The App may ask for device permissions such as notifications, which you can change in your device settings. When you use the App, it sends device and usage information (such as device model, operating system and crash reports), and the analytics in Section 9 also run in the App's ordering experience. If you created an account in the App, you can delete it from within the App (Profile > Delete).

11. How Long We Keep It

We keep personal information as long as we reasonably need it for the purposes in this policy, unless the law requires or allows longer. We consider how long you have an account or stay subscribed, whether we need the information to provide the Services, keep business records or resolve disputes, and our legal, tax and accounting obligations. Job applications are kept for at least one year, or longer where employment law requires. When we no longer need information, we delete or de-identify it.

12. Your Privacy Rights

Depending on where you live, you may have the right to:

  • know whether we process your personal information and get a copy of it;
  • correct inaccurate information;
  • delete your information;
  • opt out of the "sale" or "sharing" of personal information, targeted advertising, or certain profiling, as state law defines those terms;
  • limit the use of sensitive information, or be asked for consent first, where state law provides it; and
  • not be treated differently for using these rights.

Sensitive information. We use dietary preferences you choose to share only to provide and personalize the Services you ask for, not to infer anything about you. You can remove them from your profile at any time.

How to make a request. Email tysons@c99g.net. We will need to verify your identity, usually by confirming information we already have (such as the email or phone number on your account or orders). We will respond within the time the law requires. If we deny your request, you may appeal by replying to our decision with "Appeal" in the subject line, and if your appeal is denied, you may contact your state attorney general.

Loyalty program. Our loyalty program gives you points and rewards for your purchases. To take part, you give us your contact information and we keep track of your purchases and rewards. You can join for free and leave at any time by contacting us. We consider the program's value to be reasonably related to the value of the information you give us, based on what we spend to run the program and the rewards we give.

California residents. To the extent the California Consumer Privacy Act applies to us: in the past 12 months we have collected identifiers, customer records, commercial information (orders and loyalty activity), internet and device activity, general location, photos you submit, inferences, professional or employment information from job applicants, and sensitive information (account login and any dietary preferences you share), from the sources in Section 3, for the purposes in Section 4, and disclosed them for business purposes to the recipients in Section 6. We do not sell personal information. We do not knowingly sell or share the personal information of anyone under 16. California residents may also ask whether we disclose personal information to third parties for their own direct marketing; we do not.

13. Children

The Services are not directed to children, and we do not knowingly collect personal information from children under 13. If we learn we have, we will delete it. If you believe a child under 13 has given us personal information, email tysons@c99g.net.

14. Security

We and our service providers use reasonable administrative, technical and physical safeguards to protect personal information. No system is perfectly secure. Please keep your account login private and tell us right away if you think someone has used your account.

15. Changes to This Policy

We may update this policy. We will post the new version here and change the "Last Updated" date. If we make material changes, we will give additional notice where the law requires, such as a notice on the Site or App or an email. Continuing to use the Services after an update means the updated policy applies.
